Nikhat Sardar Khan(ACIArb) is a Partner in the Dubai office of the Firm. Nikhat has more than two decades of professional experience out of which she has practiced for 16 years in the UAE. Prior to moving to the Gulf, Nikhat practiced as a litigation lawyer in the Bombay High Court.
Nikhat serves as a mediator and has been empaneled as a mediator in His Highness Sheikh Saeed Bin Ahmed Al Maktoum’s Mediation Centre.
Her areas of expertise primarily include alternative dispute resolution, corporate and commercial practice, corporate structuring and governance, intellectual properties, construction and real estate.
Mrs. Khan plays a critical role for her clients, developing and executing clear legal strategies that support business profitability and global compliance. Her expertise and work include negotiation, mediation, arbitration (under WIPO, DIAC, LCIA, DIFC-LCIA, SIAC, ICC, GAFTA, IBA etc. rules as well as ad hoc arbitration under the UNCITRAL rules and other procedural rules). She successfully represented one of the major private equity companies of a UAE national in a claim for financial losses and costs in a complex construction dispute (DIAC arbitration). In the recent past, Nikhat also represented an Abu-Dhabi based conglomerate for multi-million dollars claim in agency contractual dispute and obtained an award in favour of the client (DIAC Arbitration). Mrs. Khan successfully represented one of the companies of the Ruler of RAK (the Employer), for financial losses and cost in a construction dispute (DIAC Arbitration) – Contract for fabrication and Erection of site fabricated equipment’s – modern dry process cement plant. Another matter was for non-payment under Design Consultancy Services Agreement for providing engineering consultancy services with respect to two projects, namely a five-star hotel development, and an apartment hotel development (DIAC Arbitration).
Nikhat’s transactional practice focused on corporate transactions, mergers and acquisitions, real estate, corporate governance matters and contracts. She regularly advises clients on due diligence, corporate structuring, and commercial issues. Nikhat has been instrumental in setting up more than three hundred companies and restructuring businesses in the UAE which includes holding companies of local government authority and quasi-autonomous organization. She also has extensive experience advising foreign and domestic
clients in technology related issues pertaining to global licensing strategy for software product, master service agreements, ERP contracts, IP laws, brand protection, agency registration and disputes.
Nikhat has sound working knowledge of relevant anti-money laundering issues, laws/regulations and is abreast with latest regulatory changes and trends within AML, CTF, and sanctions. She also advises on economic sanctions and represents prominent clients on matters that advanced into cross-border jurisdiction matters. Nikhat is an avid speaker and has delivered presentations on myriad topics including doing business in the UAE, compliance and risk management etc. at various in-house workshops and reputed forums.
Nikhat has been widely appreciated by the clients for her legal acumen and contributions in arbitration proceedings, proactive role in prevention of attachment proceedings and client servicing.
