Sarosh Zaiwalla has chaired, participated as a Tribunal member or Sole Arbitrator and acted as Solicitor/Counsel in over 1300 International Arbitrations involving ICC, LCIA, LMAA, DIAC, UNCITRAL and ad-hoc rules. He has extensive experience of Arbitrations involving the laws of countries in Europe, Russia, the Middle-East, South Asia, China, and Africa. He is a British national and speaks English, Hindi and Gujarati.

ARBITRATION EXPERIENCE

COMMERCIAL

Appointed to an ICC Tribunal in a US $multi-million dispute between a Gulf state-owned satellite corporation and a Lebanese television company. The Tribunal was chaired by Professor Herbert Kronke, President of UNIDROIT, and the dispute was under UNCITRAL rules

Appointed as Sole Arbitrator to determine a US $multi-million dispute between an Irish and Spanish company concerning a joint venture for the production of a glue plant in China. Seat in London

Appointed to the Tribunal, chaired by Bruce Harris former President of the Chartered Institute of Arbitrators, in a US $300 million international contractual dispute relating to the manufacture of security paper used for passports and government documents. Seat in Lagos and then London

Appointed as Sole Arbitrator by the President of the Law Society of England & Wales to determine a contractual agency dispute between Cadburys and a Jordanian company

Solicitor for an Indian stateowned oil and natural gas company in a London Arbitration concerning the oilrig, Western Triton 2

Appointed to the Tribunal in a US $multi-million telecoms dispute. Seat in London

Solicitor for the Government of India in various International Commercial Arbitrations in London

Appointed as Sole Arbitrator by the President of the Law Society of England & Wales to determine a US $multi-million family commercial dispute under English law concerning parties from Israel. The Arbitration seat was in London and the hearing took place in Tel Aviv

Solicitor for an Indian stateowned Fortune 500 oil major in a London Arbitration involving US $10 million against an international global trading company

Solicitor in various Grain and Feed Trade Association (GAFTA) Arbitrations in London for shipping and commercial parties

Solicitor for a Dubai-based TV company in various ICC Arbitrations against a Kenyan and Tanzanian Television channel regarding breaches of contracts in relation to the provision of media programming

Advised a Russian oil major on one of the largest Arbitration awards in Russian history

Solicitor in Arbitrations for various Indian private multinationals

ENERGY & CONSTRUCTION

Member of the Arbitration Tribunal formed under ICC Rules and chaired by the former English Court of Appeal, Judge Sir Anthony Evans, along with the former Solicitor General of India, Harish Salve. The Tribunal sat for four weeks in Mumbai, India. This US $multi-million dispute concerned the construction of a power plant in Karnataka in India and was governed by Indian Law

Appointed by the Russian Federation to a Tribunal in a US $400 million dispute concerning the exploration of coalmines in India

Appointed Arbitrator by a Danish Company to a Tribunal chaired by Lord McKenzie Stuart (former President of the European Court of Justice) along with Mr Pathak (former Chief Justice of India and member of the International Court of Justice). This US $multi-million dispute concerned the construction of a power plant near New Delhi

Appointed as Sole Arbitrator by the ICC Court to determine a US $multi-million dispute between a Japanese multinational and Indonesian company concerning the construction of water pipelines in Malaysia

Appointed as Sole Arbitrator by an Indian energy giant in a US $multi-million power dispute. Seat in Zurich

Solicitor Counsel in a major Arbitration in London on behalf of China National Petroleum Corporation (CPNC) and China Petroleum Technology & Development Corporation (CPTDC) concerning a joint venture with a Korean Company for the construction of an LPG storage tank in Maoming, China

Solicitor Counsel for China Petroleum and Engineering Construction Company (CPECC) in an Arbitration in London concerning the construction of a gathering station for a Kuwaiti Oil Corporation

Solicitor Counsel for an Iranian oil company in London concerning the Russian oilrig, Sakhalinskaya

MARITIME

Appointed to the Tribunal by a Ukrainian shipping company in an LMAA Arbitration concerning a charter-party dispute governed by English law

Appointed as Sole Arbitrator by the ICC Court to determine a US $multi-million dollar dispute between an Iranian shipping company and a Far-East shipping agency

Appointed to a Tribunal chaired by Christopher Moss, president of the LMAA, in a US $12 million dispute concerning the transport of oil sludge from Saudi Arabia to China. Seat in London

Solicitor in a large two week maritime Arbitration in New Orleans presided over by Cedric Barclay, former President of the LMAA, relating to the shipment of construction material to Dubai

Solicitor in a USD multi-million arbitration between one of the world’s largest trading houses and a Fortune 500 Indian oil major

Solicitor in various arbitrations involving time and voyage charters, bills of lading contracts, sale and purchase contracts, shipbuilding contracts, contracts for the sale of goods, marine insurance policies, and agency and commission agreements.

ASM Shipping v TTMI – Solicitor in an English High Court litigation which arose out of an arbitration. This case set the legal precedent concerning the circumstances where an arbitrator may have an ‘unconscious bias’

Union Marine v Govt of Comoros – Solicitor in an English High Court litigation that set a legal precedent in respect of whether the wording of an arbitration clause was valid under English law

MEDIATION

Accredited Mediator of the Centre of Effective Dispute Resolution (CEDR), London

Facilitated a dialogue in 1994 between the UK Prime Minister and the Chinese Government to resolve certain difficulties that had occurred relating to the Hong Kong handover in 1997

Appointed by the Dalai Lama to mediate with the Government of the People’s Republic of China in relation to the resolution of the Tibet dispute

Facilitated a successful two day mediation in Dubai in relation to a shipping partnership dispute

Successfully mediated a USD$ multi-million dollar family real estate dispute in Boston
